THE APPEAL OF PAS GIANNINA 1966 IS DISMISSED BY THE CAS
Lausanne, 16 July 2013 - The Court of Arbitration for Sport (CAS) has dismissed the appeal filed by PAS Giannina 1966 (Greece) against the decision taken on 26 June 2013 by the Adjudicatory Chamber of the UEFA Club Financial Control Body (the “UEFA decision”). As a consequence, the Greek club is not admitted to the UEFA Europa League 2013/14.
According to the initial UEFA decision, PAS Giannina violated the UEFA Club Licensing System and Financial Fair Play Regulations following overdue payables toward the Greek tax authorities on 31 March 2013 as well as for having filed financial statements which did not properly reflect the club’s true financial situation.
In its appeal to the CAS filed on 4 July 2013, the Greek club requested that the UEFA decision should be annulled, or, alternatively, replaced with a new decision including less severe sanctions. The parties, together with their representatives and witnesses were heard at a hearing held on 15 July 2013 at the CAS headquarters in Lausanne.
The CAS Panel, composed of Mr Olivier Carrard, President, (Switzerland), Messrs Efraim Barak (Israel) and Luigi Fumagalli (Italy), has decided to confirm the CAS jurisprudence in relation to financial fair-play and has dismissed the appeal. The CAS Panel issued its decision today, without the grounds, which will be communicated at a later date.
